LASIK Eye Surgery Class Action Lawsuit

Greenville attorney Wally Fayssoux is one of the seven attorneys filing a $180 million class action suit on behalf of John Hollman of Beaufort County and others. The lawsuit has been filed against TLC LASIK Center accusing the LASIK laser eye clinics of performing surgeries on patients with pre-existing conditions that should have excluded them as laser eye surgery candidates.

Medical Devices Recalls On The Rise

The rise of recalls on medical devices is a concern for anyone who uses them or has a loved one who uses them. Very often, a person is using a medical device to keep them healthy and alive, so a malfunction is often life threatening.

Todays increasingly complex production environments, company mergers, and the use of international supply sources, are causing quality problems in the medical device sector to increase. The U.S. Food and Drug Administration (FDA) device recalls for 2008 were at an all-time high, over double that of 1998. An alarming amount of these recalls were Class 1 recalls which is the most severe type as there is potential for serious injury or death.

Honda To Recall Odysseys and Elements For Brakes

Honda will be recalling over 350,000, 2007-2008 Odyssey minivans and almost 70,000, 2007-2008 Element SUVs. The company explained that, "On some of the vehicles, air could enter the unit that controls the braking and stability systems, which may result in "soft brake pedals" or "low brake pedals". "Not all vehicles recalled will have a noticeable problem as the problem develops over time."

Consumer Protection Lawsuit Filed Against Toyota

Adding to growing number of civil lawsuits from Toyota owners who have experienced unwanted acceleration or are fearful of it, Southern California prosecutor, Tony Rackauckas filed a consumer protection lawsuit against the automobile manufacturer. The suit claims that Toyota knowingly sold vehicles at risk for unintended acceleration while taking steps to hide and mislead the public about the defects. In addition to pending class-action lawsuits, Toyota also faces a probe by the Securities and Exchange Commission and a criminal investigation by federal prosecutors.

Honda And Acura Airbag Recall

Honda is recalling almost 400,000 Honda and Acura vehicles for airbag problems. The airbag inflator produces excessive pressure that may rupture the inflator which could send fragments through the airbag material possibly causing injury or fatality to the vehicle occupants. The vehicles affected by the recall are:

  • 2001-2003 CIVIC
  • 2002 CR-V
  • 2002 ODYSSEY
  • 2002-2003 Acura 3.2TL
  • 2003 PILOT
  • 2003 ACURA 3.2CL

Mazda To Recall CX-9's For "Hot Seats"

Mazda has announced a recall for certain 2010 CX-9 vehicles with heated front seats. Under cold conditions, the seat heat controller can overheat due to poor grounding. This can cause high temperatures which could lead to burn damage on the cushions and could eventually lead to smoke and fire.

Toyota Fights To Get Back On Top

Toyota's president Akio Toyoda met with Japan's premier, Yukio Hatoyama and other government officials, with a promise to restore trust in Toyota vehicles. Promising to improve quality control, Toyoda said, "We will work hard to once again become a more transparent and customer focused company."

Toyota Unable To Find Problems In Fixed Cars

U.S. regulators are reviewing more than 60 complaints that fixes made on some recalled Toyota vehicles have not solved the problem.

Nissan Recalls Brake Pedals And Gas Guages

Nissan will be recalling almost 300,000 pickup truck, sport utility and minivan vehicles in the U.S. regarding problem with brake pedals and gas gauges.
